It is unlawful for a person, with intent to defraud either the State, a county, or municipal government or any person, to act as an officer and demand, obtain, or receive from a person or an officer of the State, county, or municipal government any money, paper, document, or other valuable things. A person who violates the provisions of this section is guilty of a:

1. (1) felony and, upon conviction, must be fined in the discretion of the court or imprisoned not more than ten years, or both, if the property or thing obtained has a value of more than two hundred dollars.
2. (2) misdemeanor triable in magistrate's court, and, upon conviction, must be fined not more than one hundred dollars or imprisoned not more than thirty days if the property or thing obtained has a value of two hundred dollars or less.
