(1) As used in this rule:
- (a) “District” means a common or union high school district organized under ORS Chapter 332, a public charter school as defined in ORS 338.005, or any other education entity to which OAR 581-022-2320 applies.
- (b) “Student instructional time” means the total hours students are in school, bell-to-bell, including recess, lunch, passing time, and instruction.
(2) As of April 16, 2026, a district may not:
- (a) Further reduce scheduled student instructional time for the remainder of the 2025-2026 school year; or
- (b) Reduce scheduled student instructional time during the 2026-2027 school year.
- (3) If a district reduced scheduled student instructional time during the 2025-2026 school year, or if a district reduced planned scheduled student instructional time for the 2026-2027 school year prior to April 16, 2026, the district must restore student instructional time to no less than the planned 2024-2025 school year levels no later than the beginning of the 2027-2028 school year.
(4)
- (a) Each district described in subsection (3) of this rule shall submit to the Oregon Department of Education, in a manner required by the department, a plan under which the district will restore the student instructional time.
- (b) The plan described in paragraph (a) of this subsection must be submitted for approval to the department no later than 90 days after the effective date of this rule.
- (c) The plan described in paragraph (a) of this subsection shall include clear timelines, specific actions, and measures that ensure the full restoration of student instructional time.
- (d) The department may require a district to amend and resubmit a plan described in paragraph (a) of this subsection if the plan does not meet the requirements of paragraph (c) of this subsection.
- (5) If a district, at the direction of their school board or governing body, does not restore student instructional time as required by subsection (3) of this rule, the district shall publicize the justification for the decision in a time and manner required by the Oregon Department of Education.
