Okla. Stat. tit. 85, Rule 52
If an employee who is entitled to claim workers' compensation benefits is injured by the negligence or wrong of another not in the same employ (as further specified in 85 O.S., Section 44), the employee shall notify the Court, the employer and the employer's workers' compensation insurance carrier if the employee elects to pursue any and all remedies against the third party. Notification also shall be given by the employee to all parties named in the action against the third party. Notification shall be made by certified mail, return receipt requested, and must be filed with the Court and mailed to all parties prior to the final disposition of either the action against the third party or the filing of a Motion to Set for Trial before the Workers' Compensation Court.
