The Commissioner may issue a cease and desist order, ex parte, if:
1. The Commissioner believes:
- a. an unauthorized person is engaging in the business of insurance in violation of Section 12 of this act I or in violation of a rule promulgated pursuant to Sections 11 through 21 of this act,2 or
- b. an unauthorized person engaged in the business of insurance acting in violation of Section 13 of this act3 is committing an unfair method of competition or an unfair or deceptive act or practice in violation of Section 1201 et seq. of Mtle 36 of the Oklahoma Statutes or in violation of any rule promulgated pursuant thereto; or
- 2. It appears to the Commissioner that the alleged conduct is fraudulent or hazardous or creates an immediate danger to the public safety or is causing or can be reasonably expected to cause significant, imminent and irreparable public injury.
