If the assessment is not deducted and paid to the executive secretary as provided in Section 9 of this act, or within ten (10) days thereafter, said lien may within one (1) year after the expiration of said ten (10) days period be foreclosed by action in any court having jurisdiction in the county in which such peanuts were grown, or sold, or in which such peanuts may be found, or in which such peanuts shall have been commingled with other peanuts.
