If a person denies access to the the regulatory authority then the regulatory authority shall:

1. (1) Inform the person that:

   1. (A) The license holder is required to allow access to the regulatory authority as specified under OAC 310:257-15-23 of this Chapter,
   2. (B) Access is a condition of the acceptance and retention of a food establishment license to operate, and
   3. (C) If access is denied, an order issued by the appropriate authority allowing access may be obtained; and
2. (2) Make a final request for access.
