1. (A) Except as provided in division (B) of this section, no person shall operate any of the following, unless the person holds the appropriate license issued under this chapter and the license is valid:

   1. (1) A maternity unit;
   2. (2) A newborn care nursery;
   3. (3) A maternity home.
2. (B) Division (A) of this section does not apply to a health care facility, as defined in section 3702.30 of the Revised Code.
