1. A. Deemed to be an insurer. Upon approval of the application for registration, a self-funded MEWA is deemed to be an “insurer” under Subsection A of Section 59A-1-8 NMSA 1978.
2. B. Deemed to be an authorized issuer. Upon approval of the application for registration, a self-funded MEWA is deemed to be an authorized insurer for purposes of compliance with state and federal law.
3. C. Plan deemed to be a contract. The health benefits plan of a registered self-funded MEWA is deemed to be a health benefits plan under state and federal law.
