A county water and/or sewer district system shall supply water and sewer services to a subdivision proposed for review under Title 76, chapter 3 or 4, if:

1. (1) the proposed subdivision requests the connection;
2. (2) a boundary of the subdivision is within 501 to 1,000 feet of any component of the county system; and

3. (3) the county system meets the following requirements, as established in administrative rule by the department of environmental quality:

   1. (a) the system is approved by the department and is in compliance with Title 75, chapter 6, part 1; and

   2. (b) the managing entity of the system certifies that:

      1. (i) the system has adequate capacity to meet the needs of the proposed subdivision;
      2. (ii) the connections are authorized;
      3. (iii) the system is in compliance with applicable department regulations; and
      4. (iv) an appropriate water right exists for the connection.
