1. (1) Except as otherwise provided in subsection (2), this part applies to electronic records and electronic signatures relating to a transaction.

2. (2) This part does not apply to a transaction to the extent it is governed by:

   1. (a) a law governing the creation and execution of wills, codicils, or testamentary trusts;
   2. (b) Title 30, chapter 1, other than 30-1-107, and chapters 3 through 9A; and
   3. (c) Title 13.
3. (3) This part applies to an electronic record or electronic signature otherwise excluded from the application of this part under subsection (2) to the extent it is governed by a law other than those specified in subsection (2).
4. (4) A transaction subject to this part is also subject to other applicable substantive law.
