1. (1) In accordance with 23-4-106 , MCA, the department shall appoint an executive secretary.

2. (2) The executive secretary shall:

   1. (a) supervise race meets and oversee all activities of all racing officials;
   2. (b) hire and supervise all state racing officials for the department;
   3. (c) inspect and approve racing facilities;
   4. (d) make inquiries into the financial dealing and solvency of any licensee;
   5. (e) handle complaints and make recommendations to the board in their regard;
   6. (f) prepare agendas for all board meetings;
   7. (g) schedule hearings and have hearing examiners appointed;
   8. (h) perform other duties as directed by the board;
   9. (i) hire staff to assist him in performing his duties;
   10. (j) maintain and preserve the official records of the board;
   11. (k) approve all racing officials;
   12. (l) disburse funds; and
   13. (m) represent the board with the department.
