(1) Congregate nutrition services may be made available to:
- (a) an older adult;
- (b) the spouse of an older adult;
- (c) persons with disabilities who live in housing facilities in which mainly older adults live and which also provide congregate nutrition services;
- (d) persons providing volunteer services to a congregate nutrition service provider during meal hours.
- (2) Nutrition providers must determine eligibility for nutrition services in accordance with the criteria in (1) and standard written procedures the provider has adopted.
