1. (1) The board incorporates ARM 24.101.406 by reference with the following modification:

   1. (a) Nonviolent misdemeanor convictions for driving under the influence (DUI) in (5)(a) are routine if the conviction date is more than one year before the application date, unless the applicant is still in custody due to the conviction.
