1. (1) A residency is approved for purposes of 37-3-102(3), MCA, if the training program meets the following criteria:

   1. (a) is in a hospital or clinic located in the United States; and
   2. (b) has been approved by the Accreditation Council for Graduate Medical Education or the American Osteopathic Association.

2. (2) Alternatively, a residency is approved if, upon investigation, the board finds that the residency:

   1. (a) is approved by, or affiliated with, the World Health Organization;
   2. (b) carries malpractice insurance; and
   3. (c) requires residents to have sufficient fluency in spoken and written English to practice medicine with reasonable skill and safety.
