1. (1) Except as provided in (2), naturopathic physicians may prescribe, administer, and dispense pursuant to 37-2-104, MCA:

   1. (a) all legend drugs;
   2. (b) with a DEA registration, all drugs in Schedules II-V as listed at 50-32-224, 50-32-226, 50-32-229, and 50-32-232, MCA, and ARM 24.174.1412;
   3. (c) all biological substances including extracts and/or their products and residues;
   4. (d) topical preparations;
   5. (e) vitamins, minerals, trace minerals, enzymes, and food;
   6. (f) homeopathic preparations;
   7. (g) laboratory and diagnostic procedures;
   8. (h) all amino acids and amino acid combinations;
   9. (i) barrier contraceptives;
   10. (j) all botanical extracts and their derivatives;
   11. (k) electrolytes and fluid replacement;
   12. (l) expectorants and mucolytics;
   13. (m) hormones;
   14. (n) liver preparations; and
   15. (o) childbirth preparations.

2. (2) Naturopathic physicians may not prescribe:

   1. (a) general anesthetics;
   2. (b) mifepristone and misoprostol as an abortifacient;

   3. (c) barbiturates, except:

      1. (i) phenobarbital;
      2. (ii) butalbital; and
      3. (iii) primidone;

   4. (d) systemic oncology agents, except antineoplastic agents, in oral and topical form only:

      1. (i) 5fu;
      2. (ii) anastrozole;
      3. (iii) letrozole;
      4. (iv) mechlorethamine;
      5. (v) megestrol;
      6. (vi) mercaptopurine;
      7. (vii) methotrexate;
      8. (viii) tamoxifen; and
      9. (ix) tretinoin; and
   5. (e) ketamine.
3. (3) The licensed pharmacist member of the formulary committee formed pursuant to 37-26-301, MCA, shall serve on the committee for a four-year term unless the pharmacist resigns, or is replaced by vote of the board.
