1. (1) Each video poker game title must meet the following specifications for approval for use within the state of Montana. To be approved the game must:

   1. (a) use a deck of cards consisting of 52 standard playing cards (jokers may also be used);

   2. (b) conform to the standard rules of poker in the following manner:

      1. (i) the theoretical return of a royalty must be less than 50% of the overall theoretical return;
      2. (ii) "hand" means the cards dealt to or drawn by a player and retained at the completion of a game;
   3. (c) using a random number generator, draw and display the initial cards in order;
   4. (d) using a random number generator, replace any discarded cards, if applicable, with additional cards; and
   5. (e) display the winning hand and credits/cash value won for that hand.
