1. (1) The permittee shall notify the department of a proposed new contractor or any proposed change in a contractor responsible for day-to-day operations at a permit area. When such a change is proposed without transfer of the permit pursuant to ARM 17.24.418, the permittee shall submit the following to the department:

   1. (a) information required under ARM 17.24.303 for the contractor;
   2. (b) a statement acknowledging that the permittee is not relieved of any compliance responsibilities under the Act; and
   3. (c) a statement identifying a designated agent of the contractor.
2. (2) The contractor may not conduct any activities on the permit area unless and until the department determines that the information submitted under (1) is acceptable and satisfies the requirements of ARM 17.24.303.
