PURPOSE: This rule sets the Internet filtering standards for public schools.

- (1) Public school districts and public charter schools that offer public access computers, as defined in section 182.825, RSMo, must implement software and/or develop a policy that restricts minors’ ability to access pornographic material pursuant to section 182.827, RSMo.
- (2) Public school districts and public charter schools that receive discounts for internet access and internal connections pursuant to 47 U.S.C. section 254(h) and (l) must certify that they are compliant with the Children’s Internet Protection Act (CIPA) (47 CFR section 54.520), which requires the public school district or public charter school to have an Internet safety policy. Therefore, 47 U.S.C. section 254 and 47 CFR section 54.520 are hereby incorporated by reference and made part of this rule, as published by the U.S. Government Publishing Office, 732 North Capitol Street, NW, Washington, DC 20401- 0001, on June 2021. A copy of these regulations can also be obtained from the Department of Elementary and Secondary Education, Office of Quality Schools, 205 Jefferson Street, PO Box 480, Jefferson City, MO 65102-0480, and its website at https://dese.mo.gov/governmental-affairs/dese-administrativerules/incorporated-reference-materials. - (3) Public school districts and public charter schools must annually certify to the Department of Elementary and Secondary Education through the Assurance Checklist if they have met either section (1) or (2) of this provision, based on their circumstances.
