PURPOSE: This rule requires that the railroad companies operating in Missouri provide telephone facilities so that those offices of the railroads controlling the movement of trains may be contacted by outside agencies in case of emergencies.

1. (1) Unless permission has been received from the division for a variance every railroad operating within this state shall maintain a telephone number twenty-four (24) hours a day at a location from which the railroad has immediate communication with the dispatcher or other railroad employees having control over the movement of trains. The railroad shall use this telephone number only for the purpose of receiving emergency communications.

2. (2) The railroad shall provide this division with the following:

   1. (A) Number of the telephone;
   2. (B) Location of the telephone; and
   3. (C) Notice of any change to the telephone number or location ten (10) days prior to the change. AUTHORITY: section 622.027, RSMo 1986.* Original rule filed May 2, 1991, effective Dec. 9, 1991. *Original authority 1985.
