PURPOSE: This rule effectuates or aids in the interpretation of sections 354.085, 354.485, 376.405, 376.675 and 376.777, RSMo regarding life and health benefits relating to HIV infection.
(1) Definitions. For the purposes of this regulation—
- (A) AIDS means acquired immunodeficiency syndrome;
- (B) ARC means AIDS related complex; and
- (C) HIV means human immunodeficiency virus as these terms from time-to-time may be defined by the Federal Center for Disease Control.
(2) General Exclusions.
- (A) On the effective date of this rule (January 13, 1989) all new or renewed individual or group policies, certificates, riders, endorsements or other supplemental forms which provide accident or health benefits issued by an insurance company, health service corporation, health maintenance organization or fraternal benefit society, other than those providing coverage only for specified diseases, shall cover HIV infection, including AIDS and ARC, as they would any other serious medical condition.
- (B) All life insurance policies, other than those providing coverage for specific causes of death only, shall cover death from AIDS or ARC-related causes as they would death from any other cause.
