PURPOSE: This rule complies with section 324.012.7, RSMo, and details the process for an individual to request a pre-licensure determination of their criminal record under the Fresh Start Act. This rule also provides the requirements for a decision on a pre-licensure determination.

1. (1) For purposes of this regulation, all terms shall have the same definition as contained in section 324.012, RSMo.
2. (2) Individuals requesting a pre-licensure criminal history determination under the Fresh Start Act must complete the request on a form approved by the Division of Professional Registration and its boards, commissions, committee, and offices of the Division of Professional Registration.
3. (3) Within thirty (30) days after a licensing 20 CSR 2231-3

board has met, but not later than four (4) months after a complete request of a prelicense criminal history determination, the division or respective licensing board shall issue a written order of its determination as required pursuant to section 324.012, RSMo.
