Mo. Code Regs. Ann. tit. 2, § 90-20.040 – NIST Handbook 130, “Uniform Regulation for the Method of Sale of Commodities”

PURPOSE: This rule achieves, to the maximum extent possible, uniformity in weights and measures laws and regulations among states and local jurisdictions, which facilitates trade between the states and provides uniform and sufficient protection to all consumers in weights and measures.

SUMMARY: The sections of NIST Handbook 130 pertaining to regulation of the method of sale of commodities are a result of the combined efforts of the National Conference on Weights and Measures, the National Institute 2 CSR 90-20

of Standards and Technology (NIST) and state divisions of weights and measures. The method of sale of commodities regulation prescribes approved method of sale of food and nonfood products, presentation of price, allowable differences, combination quantity declarations, machine vended commodities and railroad car tare weights.

(1) The rule for the division of Weights and Measures for method of sale of commodities shall incorporate by reference the section of the NIST Handbook 130, 1998 edition, entitled “Regulation for the Method of Sale of Commodities.”
(2) Should any portion of the regulation of method of sale of commodities as defined in Handbook 130 be deemed unacceptable, rules will be promulgated within this chapter denoting and excepting those portions, and adopting alternative provisions as deemed necessary by the director of the Department of Agriculture.
