PURPOSE: This rule sets stipulations on pesticide dealers’ licenses. This rule is necessary to keep unlicensed persons from masquerading as pesticide dealers.

1. (1) A pesticide dealer must display their license at all times in a prominent place at the outlet from which they will sell restricted use pesticides, the address of which shall be printed on the license. In the case of pesticide dealers who sell restricted use pesticides by traveling on the road from place to place, the license shall be carried on the person of the licensee.
2. (2) Licensed pesticide dealers shall only sell, offer for sale, or distribute restricted use pesticides to licensed pesticide dealers or certified applicators who are eligible under 2 CSR 70-25.080(4) to purchase or acquire restricted use pesticides by holding valid certification in proper certification categories.
