PURPOSE: Establishes penalties for violating the act.

1. (1) If the director determines, after inquiry and opportunity for a hearing, that any individual is in violation of any provision of section 192.945, 195.207, or 261.265, RSMo or any regulations issued thereunder, the director shall have the authority to assess a civil penalty, not to exceed two thousand five hundred dollars ($2,500), issue a letter of enforcement action, or refer the violation to the Missouri Attorney General’s Office for prosecution.

   1. (A) In the event that a person penalized under this section fails to pay the penalty, the director may apply to the circuit court of Cole County for, and the court is authorized to enter, an order enforcing the assessed penalty.
