Scale Tickets

PURPOSE: This rule defines a scale ticket, states when the tickets must be completed and what information they must contain.
- (1) A scale ticket is a form of nonnegotiable warehouse receipt. Scale tickets must be issued for each movement of grain into a licensed public grain warehouse, except that the director may approve other documents on a case-by-case basis to be considered scale tickets when issued in lieu of in-bound scale tickets. Each warehouseman shall submit a copy of each type of scale ticket, or other document used in place of in-bound scale tickets, for approval by the director prior to their use. Any time an approved in-bound scale ticket or alternative approved document is revised, it shall be submitted to the department for approval prior to beginning its use.
- (2) A scale ticket also must be issued for each movement of grain out of a licensed public grain warehouse, except for feed, seed, railcar or barge movement for which other documentation is made that states the type and estimated quantity of grain moving out of the warehouse.
- (3) Any type of approved scale ticket or other approved document which is on file with the department shall be considered prima facie evidence of a claim against the warehouse. Approved documentation, at a minimum, must state the type and quantity of grain and all terms agreed to by the parties. If weight or quantity is estimated, all parties must sign the document and be given a copy of the document.
- (4) Scale tickets shall be preprinted with the warehouse name and location and be consecutively numbered. They must be issued in consecutive order. Warehousemen must retain the purchase documents on any scale tickets they have printed.
(5) All scale tickets issued shall contain the following information:
- (A) What type of grain was weighed;
- (B) Whether the grain movement was IN or OUT;
- (C) If movement was IN, whether the grain was received for storage, purchase by the warehouseman or other specified purpose;
- (D) If received for purchase by the warehouseman, the price shall be stated on all copies;
- (E) Gross, tare and net weights; and
- (F) Any standard grain grading factors determined.
- (6) A copy of all scale tickets and other documents of evidence for movements in or out of the warehouse shall be kept on file in numerical order in the warehouseman’s office for three (3) years after the issuance date, however, those scale tickets issued as a basis for the issuance of negotiable warehouse receipts shall be kept on file in numerical order for three (3) years after the cancellation date of the related warehouse receipt.
