PURPOSE: This rule clarifies who may weigh or supervise the actual weighing of grain at terminal warehouse locations, as well as at other grain warehouse locations, in Missouri as described in sections 411.030 and 411.160, RSMo.

1. (1) The department has the exclusive right to perform Class I and Class II weighing, and the subsequent certification, in terminal warehouses, as well as at all other grain warehouse locations in Missouri; except that, grain exchanges or boards of trade may weigh or supervise the weighing of grain in Missouri.

   1. (A) Class I is defined as—A weight documented by a certificate issued by a weigher that has been duly appointed by the director Fee

1. (B) Class II is defined as—A weight documented by a weight certificate issued by a weigher that has been duly appointed by the director and qualified according to law using an approved scale under a minimum of twenty-five percent (25%) supervision of a disinterested third party.
2. (C) Grain exchanges and boards of trade are defined as—Any associations or organizations that are formed in conformity with, operate in conformity with and are governed by the provisions of sections 276.090— 276.150, RSMo.
3. (D) Terminal warehouse is defined as— Any warehouse where the department makes available inspection and weighing services.
