PURPOSE: This rule establishes the requirements that the area agency shall meet to develop or amend and submit an area plan.

1. (1) The area agency shall develop the area plan in accordance with all applicable federal and state regulations, the uniform plan format and other guidelines issued by the division.
2. (2) The area plan shall encompass a planning period as specified by the division. However, fiscal budgets, including allotments/funds for services and planned service delivery shall be amended at least annually or as available allotments/funds change.

3. (3) The area plan shall be amended under the following situations:

   1. (A) A new amended state or federal statute or regulation requires a new provision or conflicts with any existing provisions;
   2. (B) A supreme court decision changes the interpretation of a statute or regulation;
   3. (C) The area agency changes the designation of the single organizational unit or component unit;
   4. (D) Receipt by area agency staff or board members of compensation or other items of value above their salaries or the normal fringe benefits available to all staff; and
   5. (E) The area agency takes any action for which prior division approval is required by state regulation, divisional policy, or preprint instructions.
4. (4) The area plan or plan amendments shall not be implemented until approved in writing by the division.
