PURPOSE: This rule outlines how the Department of Health and Senior Services ensures that expenditures are compliant with annual General Assembly budget bills.

1. (1) After July 1 of each calendar year, no claims for payment shall be submitted by any provider until that provider submits the requisite form issued by the department to be used for the upcoming fiscal year. Such form shall contain the applicable provisions related to legislative authority regarding expenditure of funds, including but not limited to, definitions, restrictions, and prohibitions. Such form shall also contain a 19 CSR 10-15 DEPARTMENT OF HEALTH DIVISION 10—OFFICE OF THE AND SENIOR SERVICES DIRECTOR

declaration to be executed by the provider, which shall state that said provider will not submit claims for payment that violate the applicable provisions related to the legislative authority regarding expenditure of funds. This form shall be effective from the date that the department receives a provider’s executed copy until a new form is issued by the department. A copy of this form can be requested by contacting the department.
