PURPOSE: This rule clarifies situations in which a member is entitled to purchase prior service as prior creditable service.
(1) A member may be entitled to purchase past service as prior creditable service if it has accrued in one (1) of the following manners:
- (A) The employee has opted out of membership in the County Employees’ Retirement Fund for a period of time and then later elects to become a member of the County Employees’ Retirement Fund in accordance with applicable laws and regulations;
- (B) The employee was employed by the county on or after August 28, 1994, and had been employed as a county employee prior to August 28, 1994; or
- (C) The employee qualifies as a special consultant as outlined in 16 CSR 50-3.060. AUTHORITY: section 50.1032, RSMo 1994.* Original rule filed Oct. 11, 1995, effective May 30, 1996.
