Waiting Periods Regarding Long-Term Disability Benefits

PURPOSE: This rule establishes the policy regarding the commencement of a new waiting period for long-term disability benefits.
- (1) If an employee returns to work before the 181st day of disability and works for ten (10) working days, then the employee will be required to start a new waiting period. If the employee returns to work and works for less than ten (10) days, then no new waiting period will be required.
- (2) If an employee returns to work after longterm disability benefits commence and works for more than six (6) months and again becomes disabled, the employee will be required to wait for a period of one hundred eighty (180) days before again receiving longterm disability benefits. If the employee works for six (6) months or less and then becomes disabled, the employee will not be required to start a new waiting period.
