PURPOSE: This rule complies with section 536.023(3), RSMo which requires each agency to adopt as a rule a description of its operations and the procedures where the public may obtain information or make submissions or requests.
- (1) Description of Board of Trustees. Under sections 104.010–104.270 and 104.600– 104.620, RSMo, the Highway and Transportation Employees and Highway Patrol Retirement System is administered by a board of trustees. The board consists of three (3) members of the Highway and Transportation Commission, the chief engineer of the Highway and Transportation Department, the superintendent of the State Highway Patrol, one (1) member of the senate, one (1) member of the house of representatives, one (1) active member of the Highway and Transportation Department, one (1) active member of the State Highway Patrol and one (1) retired member previously employed by either the Highway and Transportation Department or the State Highway Patrol. The senator and representative are appointed by the president pro tem of the senate and the speaker of the house, respectively. Active members from the Highway and Transportation Department and State Highway Patrol are elected by a plurality vote of the active and vested members of their respective departments to serve four (4)-year terms. The retired member is elected by a plurality vote of all retirees of the retirement system for a four (4)-year term. Each member is encouraged to participate in this election.
- (2) Officers of Board of Trustees. Under sections 104.010–104.270 and 104.600– 104.620, RSMo, the chairman and the vicechairman are elected by the board of trustees. Under section 104.230, RSMo, the chief counsel of the Missouri Highway and Transportation Commission furnishes necessary legal services.
- (3) Contributions. The cost of the retirement plan is paid entirely from the state funds. Benefits, average age of members, average lifespan of members and investment earnings are some of the factors that influence the contribution necessary to keep the system actuarially sound.
- (4) Benefits. In addition to benefits paid upon retirement, the Highway and Transportation Employees and Highway Patrol Retirement System provides, at the member’s election, an annuity to continue to the member’s spouse after the member’s death. The retirement system also provides for those who qualify—disability benefits, survivor benefits for the member’s spouse or unemancipated children under age twenty-one (21) and a deferred annuity for members terminating employment.
