Disparity in Physicians’ Opinions

PURPOSE: This rule establishes a procedure for additional medical review if there is a disagreement between the recommendations of the employee’s physician and MOSERS’ medical reviewer.
- (1) When a member makes application for disability benefits, or when a member who is receiving disability benefits is re-examined, the MOSERS’ medical reviewer’s recommendation will be accepted by the retirement system. If appealed, the determination made by the second MOSERS’ physician reviewer will be followed. If again appealed, the board of trustees’ decision will prevail.
- (2) If any examination is requested by the retirement system to provide information/updated information for the MOSERS’ medical reviewer, the retirement system will pay up to fifty dollars ($50) for the physician’s examination, including any tests required. The retirement system reserves the right to select the physician to do the examinations.
- (3) This rule applies only to the disability retirement plan.
