PURPOSE: This rule prohibits the payment of Temporary Assistance to minor children who are absent from the home for a significant period of time.

1. (1) For the purpose of the administration of the Temporary Assistance Program, the Division of Family Services shall not provide assistance to or on behalf of—

   1. (A) A minor child who has been, or is expected by a parent (or other caretaker relative) of the child to be, temporarily absent from the home for a period exceeding ninety

2. (90) consecutive days; or

   1. (B) An individual who is a parent (or other caretaker relative) of a minor child and who fails to notify the Division of Family Services 13 CSR 40-2

of the absence of the minor child from the home for the period specified in or provided for pursuant to subsection (1)(A), by the end of the five (5)-day period that begins with the date that it becomes clear to the parent (or relative) that the minor child will be absent for such period so specified or provided for.
