Prohibition Against Payment of Temporary Assistance to Families That Do Not Include a Minor Child

PURPOSE: This rule prohibits the payment of Temporary Assistance to families that do not include a minor child. (1) For the purpose of the administration of the Temporary Assistance Program the Division of Family Services shall not provide assistance to or on behalf of a family—
(A) Unless the family includes:
- 1. A child under the age of eighteen (18)
who resides with a custodial parent or other adult caretaker relative of the minor child; or
- 2. A child under the age of nineteen (19)
and a full-time student in a secondary school (or at the equivalent level of vocational or technical training), if the child may reasonably be expected to complete the program of the secondary school (or vocational or technical training); and
- (B) If the family includes an adult who has received public assistance through a program funded in whole or part through the Temporary Assistance for Needy Families (TANF) Block Grant, section 603 of Title 42, United States Code (including the Temporary Assistance Program), for a total of five (5) years (sixty (60) cumulative months, whether or not consecutive) unless an exception described in 13 CSR 40-2.350 applies. As used in this paragraph “assistance” is defined as set forth in 13 CSR 40-2.300, whether provided in Missouri or another state or territory, or whether provided before or after the effective date of these rules.
