PURPOSE: This rule defines the application procedures for Income Maintenance cases.

1. (1) Any person shall have the right to file an application included herein for any type of assistance or service administered by the Family Support Division. The Family Support Division shall inform the applicant of the types of assistance and services which are available, the requirements of eligibility, and additional information necessary, if any, to determine eligibility.

2. (2) Applications must be approved or denied in accordance with the timeframes established by federal and state law except when—

   1. (A) The application is incomplete or is missing information that is necessary to complete an eligibility determination; or
   2. (B) The division cannot reach a decision because the applicant or an examining physician delays or fails to provide the information necessary to make an eligibility determination.
3. (3) Failure to make a decision within the timeframes established by federal and state law does not result in an automatic determination that the applicant is eligible for any type of assistance or service.
4. (4) Applications submitted by mail, telephone, or any commonly available electronic means shall be accepted and treated the same as an in-person filing of an application.
5. (5) An application is not considered complete without a signature. Signature shall include electronic, telephonically recorded, and handwritten signatures.
6. (6) All information provided to the Family Support Division, shall be true, accurate, and complete.
7. (7) The participant and applicant shall disclose all information which may impact eligibility for any Income Maintenance program. The participant and applicant have a continuing obligation to notify the division if any information specified in the application changes within ten (10) days of the change. The continuing duty includes, but is not limited to, disclosing any changes in income of the participant or household member, changes in residence or mailing address, and the addition or removal of any individual from the household whose information is or was required to be submitted.
