Confidentiality of Case Records

PURPOSE: The purpose of this rule is to regulate the disclosure of information contained in records of the division relating to youths committed to the division.
- (1) Information contained in the records of the division relating to any child committed to it shall be considered confidential. Full disclosure of this information shall be made to the parents or guardians, or if they be outof-state, to the nearest immediate relative of such child upon reasonable notice and request. The division may require the request be made in writing.
- (2) School records maintained by the Division of Youth Services (DYS) may be shared with the school. Information other than DYS school records may be obtained by the school through the juvenile office.
- (3) Information may be disclosed to those persons or agencies actively involved in providing care or treatment services to the youth or his/her family providing that a release of information has been signed by the youth’s parent or guardian or upon a waiver signed by the former client.
