PURPOSE: This rule establishes criteria for issuance of Class C (occupational) licenses.

1. (1) Every individual participating in horse racing in any capacity is required to have an occupational license from the commission authorizing him/her to be employed on the licensed premises to practice his/her business, profession or skills, except for public officers and public employees engaged in the performance of their official duties and other individuals exempted by the commission.
2. (2) As a condition of licensing, all applicants for occupational licenses are required to be fingerprinted and photographed.
3. (3) The applicant must demonstrate that his/her experience, reputation, competence ‘_ and financial responsibility are consistent , with the best interests of horse racing and the provisions of Missouri and United States Statutes.

4. (4) The commission may refuse an occupation license to any individual-

   1. (A) Who has been convicted of a crime;
   2. (B) Who is unqualified to perform the duties required of the applicant;
   3. (C) Who fails to discloseorstatesfalsely any information called for in the application;
   4. (D) Who has been found guilty of a violation of sections 313.500-313.710, RSMo or of the rules of the commission;
   5. (E) Whose license has been suspended, revoked or denied in any racing jurisdiction for just cause;
   6. (F) Who is a past or present member or participant in organized crime as such membership or participant may be found or determined by the commission;
   7. (G) Who is an illegal alien;
   8. (H) Who is an employee of the commission or any spouse, child, brother, sister or parent of any employee or member of commission; [I) Who is financially irresponsible;
   9. (J) who is not of good moral character; or
