PURPOSE: This rule establishes certain provisions for the draw games contract.

1. (1) In addition to provisions of the draw games contract unique to each retailer, the draw games contract may provide the following provisions:

   1. (A) A discount commission of a percentage set by the executive director of draw games tickets sold by the retailer;
   2. (B) An installation fee as may be established by the executive director;
   3. (C) If the retailer has purchased a business where a terminal has previously been installed, reconnection fees may be charged as may be established by the executive director;

   4. (D) Requirements that the retailer—

      1. 1. Sell all games as required by the lot-

tery;

1. 2. Furnish players with proper claim

forms provided by the lottery;

1. 3. Provide winning numbers;
2. 4. Attend training provided by the lot-

tery;

1. 5. Allow only trained personnel to oper-

ate terminals;

1. 6. Report malfunctions as soon as prac-

ticable; and

1. 7. Prominently display point-of-sale and

other game-related materials and equipment.

1. (E) A weekly communications fee as established by the executive director; and 12 CSR 40-85
2. (F) Hold the retailer liable for negligent or intentional damage to or loss of lottery or vendor equipment.
