PURPOSE: This rule provides that licensees own Scratchers tickets after they are delivered to the licensee and the licensee shall bear the burden of any loss. The executive director may establish policies after consideration of circumstances to relieve the licensee of some or all of the burden of loss.

The licensee shall be responsible for all tickets upon delivery to the retailer and shall bear the burden of any loss, including theft, damage, or loss. The executive director of the lottery may establish policies which, after consideration of the circumstances of the licensee’s loss, relieve the licensee of some or all of the burden of loss. The policies established by the executive director shall be made with the overall functionality of the lottery and the purpose of maximizing the funds available for appropriation as set forth in the Missouri Constitution, Article III, Section 39(b).
