PURPOSE: This rule sets forth the factors the director shall consider in determining whether to issue a license.

1. (1) In determining whether to license any person as a retail sales agent, the director shall consider the following factors: 12 CSR 40-40

   1. (A) The financial responsibility and security of the person and his/her business or activity;
   2. (B) The accessibility of the proposed license location;
   3. (C) The sufficiency of any existing licenses to best serve the public interest;
   4. (D) The volume of expected sales at the location;
   5. (E) The provisions for security of the lottery operation on the license premises;
   6. (F) The effect the proposed licensee will have on the overall security and efficiency of operation of the state lottery; and
   7. (G) The veracity of the information supplied in the application.
