PURPOSE: This rule clarifies titling, registration, use and regulation of motorized bicycles. 12 CSR 10-23

1. (1) Section 301.010(18), RSMo defines a motorized bicycle as any two (2)-wheeled or three (3)-wheeled device having an automatic transmission and a motor with a cylinder capacity of not more than fifty (50) cubic centimeters, which produces less than three

2. (3) gross brake horsepower and is capable of propelling the device at a maximum speed of not more than thirty (30) miles per hour on level ground.

   1. (A) Because a motorized bicycle (moped) is neither a vehicle nor a motor vehicle, the Department of Revenue does not title or license these units.
   2. (B) Motorized bicycles are not required to be licensed to be operated on the streets and highways. The registration requirements of Chapter 301, RSMo pertain only to motor vehicles, trailers and all-terrain vehicles.
   3. (C) Motorized bicycles may not be operated upon any interstate highway. They may be operated upon any other public street or highway.
   4. (D) The operator of a motorized bicycle does not have to be motorcycle qualified to operate this unit.
   5. (E) The motorcycle helmet law does not apply to motorized bicycles.
   6. (F) Those persons engaged in the business of selling motorized bicycles do not have to be registered dealers.
   7. (G) An operator of a motorized bicycle is subject to point assessment for moving violations.
   8. (H) An operator of a motorized bicycle shall have a valid driver’s license.
