PURPOSE: This rule complies with section 536.023, RSMo 1986 which requires each agency to adopt as a rule a description of its operation and the method by which the public may obtain information or make submissions or requests.
- (1) The Department of Natural Resources
- (DNR) is authorized under sections 260.200- 260.245, RSMo to administer the sate solid waste management program. The director of the Department of Natural Resources appoints the solid waste management program director and staff. The program director and staff provide day-to-day operation of the solid waste management program.
- (2) Among its operations the solid waste management program performs the following administrative and technical functions: develop and adopt rules relating to solid waste management systems; review and approve engineering design plans and issue operating permits for solid waste disposal areas and solid waste processing facilities; review and approve comprehensive solid waste management plans submitted by cities and counties; develop and update the state solid waste management plan; conduct investigations of solid waste management systems, solid waste disposal areas or solid waste processing facilities; prepare department orders to correct violations of the sold waste management law, sections 260.200–260.245, RSMo; hold public hearings to evaluate city and county solid waste management systems; recommend to the department director the prosecution of a person violating sections 260.200–260.245, RSMo; provide solid waste management technical assistance to local governments and the public including the training of personnel; conduct solid waste management system studies, research, demonstration projects and investigations; and cooperate with appropriate units of government and private organizations to improve solid waste management practices. The solid waste management program also provides a service of making preliminary landfill site investigations to advise any person desiring to operate a landfill whether a proposed site appears geologically and environmentally suitable prior to investment in engineering plan development. This service is provided with the assistance of the 10 CSR 80-1
department’s Division of Geology and Land Survey and the regional office program.
- (3) Any sanitary landfill that cannot demonstrate compliance with the site selection restrictions of 10 CSR 80–3.010(4)(B) shall submit a closure plan to the Missouri director of DNR in accordance with this chapter.
- (4) Requests for permit applications, requirements or other permit information, copies of solid waste rules, site investigation, technical information and assistance and any other submissions are to be made to the department’s solid waste management program office, Jefferson City, MO 65101 or to one of the department’s regional offices.
