PURPOSE: The purpose of this rule is to comply with section 536.023, RSMo 1986 which requires each agency to adopt as a rule a description of its organization, operation and method by which the public may communicate with the agency.
- (1) The director of the Department of Natural Resources is authorized in section 444.355, RSMo Supp. 1989 to have and exercise all powers provided in the Metallic Minerals Waste Management Act, sections 444.352— 444.380, RSMo Supp. 1989. This act regulates disposal of waste from metallic minerals mining, beneficiation and processing. Some of the director’s duties are to secure appropriate staff, coordinate existing environmental programs, issue permits, make inspections, manage fees, maintain records of management practices, seek additional funds, promulgate rules and pursue appropriate enforcement actions.
- (2) Operators of metallic mineral facilities must make application for a Metallic Minerals Waste Management Permit. The minimum contents of this application are listed in section 444.360, RSMo. This application shall include a closure plan and an inspection-maintenance plan which will ensure the containment of metallic minerals wastes. Each plan must be coordinated with other environmental permits regulating water quality, air quality, solid waste disposal and dam safety.
- (3) The Department of Natural Resources staff working under the provisions of the Metallic Minerals Waste Management Act are within the Division of Environmental Quality, Land Reclamation Program with its central office in Jefferson City, Missouri. Local information can be obtained from one
- (1) of six (6) regional offices located in Jefferson City, Kansas City, Macon, Poplar Bluff, St. Louis and Springfield.
