PURPOSE: This rule sets forth the requirements and process of application for a state grant to match Environmental Protection Agency construction grants for construction of wastewater treatment works and the terms and conditions for receipt of a grant. This rule also clarifies the requirements, the types of facilities funded and the grant amount available for eligible grantees.

1. (1) For conventional technology, the state share may be up to twenty-five percent (25%) 10 CSR 20-4

of the eligible project costs and for innovative alternative technology, the state share may be up to fifteen percent (15%) of eligible project cost.

1. (2) Eligible applicants are those applicants who have received Environmental Protection Agency (EPA) funding assistance under the EPA construction grants program.
2. (3) Facilities to be constructed are limited to those that are eligible under the EPA construction grant program and further limited by the commission policy.
3. (4) Priority will be based upon the priority system for the EPA construction grants as adopted by the commission.
4. (5) State payments will be processed upon notification from EPA that the federal reimbursement has been made.
5. (6) Grantees must provide for a thirty (30)- day minimum formal advertising period (the time between the date of the first public publication and the date by which bids must be submitted) for all construction and equipment procurements. Small purchase procurement (40 CFR 31.36(d)(1), effective October 1, 1988) is exempt from this requirement. Solicitations, at a minimum, shall be placed in newspapers of general circulation.
