(A) All complaints shall be in writing. iB) The uetitioner shall include in the
- 1. The full name. address and teleuhone
\ number of-
- A. The petitioner; and
- B. Any attorney representing peti-
tioner;
- 2. Suitable space in the caption for the
commission to affix a case number;
- 3. That the petitioner is a provider;
- 4. The identification and date of the
department’s action which the petitioner is appealing; and
- 5. If the petitioner seeks reimbursement,
that the amount to be reimbursed exceeds five hundred dollars ($500).
- (C) The petitioner shall accompany his/her complaint with a copy of the department’s notice of the action which rives rise to the complaint.
(D) The pet,itioner or petitioner’s legal counsel shall sign the complaint.

- (E) The complaint may contain a motion for stay.
- (2) The petitioner shall file the original of the complaint at the commission’s office with sufficient copies for all parties.
- (3) Notice. The commission shall serve notice of and a copy of the complaint on petitioner and the department by delivery or certified mail.
- (4) The petitioner may amend the complaint without the commission’s leave any time before the department serves a responsive pleading. After the department serves a responsive pleading, petitioner shall amend the complaint only with the commission’s leave.
- (5) The commission shall construe the provi. sions of this rule liberally if the petitioner has prepared the complaint without legal counsel.
