Minn. Stat. § 260C.325
Subd. 1. Guardianship.
(a) When the court terminates parental rights of both parents or of the only known living legal parent, the court shall order the guardianship of the child to:

Subd. 3. Both parents deceased.
(a) If upon petition for guardianship by a reputable person, including but not limited to the responsible social services agency as agent of the commissioner of children, youth, and families, and upon hearing in the manner provided in section 260C.163, the court finds that both parents or the only known legal parent are or is deceased and no appointment has been made or petition for appointment filed pursuant to sections 524.5-201 to 524.5-317, the court shall order the guardianship of the child transferred to:
