Minn. Stat. § 423B.10
Subd. 1. Entitlement; benefit amount.
Subd. 2. Survivor benefit coverage for a member convicted of a felony.
The surviving spouse or a surviving child of a deceased member who was convicted of a felony may not be deprived of a survivor benefit by reason of the conviction unless the person was a party to the commission of the felony. For a member who is receiving a pension at the time of conviction, a survivor who was not a party to the commission of the felony remains entitled to receive the survivor benefit provided for in subdivision 1, in the event of the member's death.
* NOTE: As of September 3, 2004, the Minneapolis City *Council had not filed with the secretary of state a certificate *of approval of an amendment to subdivision 1 made by Laws 2004, *chapter 267, article 18, section 6. Accordingly, the amendment *is not included in the text here. If a certificate is filed *before January 4, 2005, the amendment is effective the day after *its filing. If the filing with the secretary of state does not *occur before January 4, 2005, the amendment is disapproved. *Minnesota Statutes, section 645.021, subdivision 3.
