Perishable Farm Products Examination

- (a) When perishable farm products are shipped to or received by a farm products dealer for handling, purchase, or sale in this state, and the farm products dealer finds the perishable farm products to be in a spoiled, damaged, unmarketable, or unsatisfactory condition, the dealer must have the perishable farm products examined by an inspector assigned by the commissioner for that purpose. The inspector must execute and deliver a certificate to the farm products dealer stating the day, the time and place of the inspection, and the condition of the perishable farm products and mail or deliver a copy of the certificate to the shipper of the perishable farm products.
- (b) This section does not apply when the parties to the perishable farm products sales contract waive the inspection requirement.
