KRS 230.215(2) authorizes the Kentucky Horse Racing and Gaming Corporation to regulate conditions under which thoroughbred racing shall be conducted in Kentucky. KRS 230.260(8) authorizes the corporation to prescribe necessary and reasonable administrative regulations and conditions under which horse racing at a horse race meeting shall be conducted in this state. This administrative regulation establishes procedures for use of an off-site facility if a racing association's licensed premises becomes temporarily unsuitable for its intended use.
Section 1. If any Kentucky racing association's licensed premises is temporarily rendered unsuitable for its intended use, an association may, with corporation authorization pursuant to KRS 230.300(11), occupy an alternate facility during the period that its licensed premises is temporarily unsuitable, if the alternate facility meets the following conditions:
