1. (a) Any person subject to this code shall be punished at the direction of a commanding officer, whether or not the prisoner was committed to such person's charge in strict compliance with the law if such person:

   1. (1) Without proper authority, releases a prisoner;
   2. (2) through neglect or by design, allows any prisoner to escape; or
   3. (3) unlawfully drinks any alcoholic beverage with a prisoner.
